By creating an account or using Scan55 ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms form a legally binding agreement between you ("Customer") and Scan55 ("we", "us", "our"), a company registered in the United Kingdom.
Scan55 provides a software-as-a-service (SaaS) platform that allows hospitality businesses to create, manage, and publish digital menus accessible via QR codes. Features include menu management, QR code generation, customer analytics, and billing management.
New accounts receive a 14-day free trial with full Platinum access. No credit card is required to start a trial. At the end of the trial period, you must select a paid plan to continue using the Service. We reserve the right to modify or discontinue the trial offer at any time.
You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until that date. We do not offer pro-rata refunds for unused time on monthly plans.

Scan55 acts as your Data Processor and will process customer data only on your documented instructions in accordance with our Data Processing Agreement (available on request).
Scan55 and all associated software, designs, and content are owned by us and protected by UK and international intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service. You retain ownership of your menu content and business data.
We aim for 99.9% monthly uptime. Planned maintenance will be communicated in advance where possible. We are not liable for downtime caused by third-party infrastructure providers, force majeure events, or circumstances beyond our reasonable control.
To the maximum extent permitted by law, Scan55's total liability to you for any claim arising from these terms or use of the Service shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential losses including loss of revenue, loss of data, or loss of goodwill.
You agree to indemnify and hold Scan55 harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your menu content, your collection of customer data, or your breach of these terms.
We reserve the right to suspend or terminate your account immediately if you breach these terms, fail to pay, or use the Service in a way that could harm us or other users. Upon termination, your data will be retained for 30 days then permanently deleted, except where retention is required by law.
We may update these terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
